Policy Concerning Junk E-mail/Spam/Unsolicited Email
Unsolicited and/or commercial email is not permitted to the domain http://www.capturehits.com. Emails sent to capturehits.com (such as info@capturehits.com) will be investigated and any emails which constitute unsolicited/commercial emails are recorded automatically and any future mailings to capturehits.com will result in the violator being billed for message transmission and storage services at a flat rate of $100.00 per message received.

Sending unsolicited/spam email communication to any address containing the domain name, “capturehits.com," constitutes legal notice and acceptance of this policy. This is the only notice which violators will receive.

A second unsolicited email to this account will also result in action against you under the terms of applicable U.S. law, including Title 47, Sec.227(b)(1)(C) of the U.S. Code, as follows:

US Code Title 47, Sec.227(b)(1)(C):

"It shall be unlawful for any person within the United States to use any telephone facsimile machine, computer, or other device to send an unsolicited advertisement to a telephone facsimile machine"

A "telephone facsimile machine" is defined in Sec.227(a)(2)(B) as:

"equipment which has the capacity to transcribe text or images (or both) from an electronic signal received over a regular telephone line onto paper."

Under this definition, an e-mail account, modem, computer and printer together constitute a fax machine.

The rights of action are as follows. Under Sec.227(b)(3)(B):

"A person or entity may, if otherwise permitted by the laws or rules of court of a State, bring in an appropriate court of that State --

(A) an action based on a violation of this subsection or the regulations prescribed under this subsection to enjoin such violation,
(B) an action to recover for actual monetary loss from such a violation, or to receive $500 in damages for each such violation, whichever is greater, or
(C) both such actions. If the court finds that the defendant willfully or knowingly violated this subsection or the regulations prescribed under this subsection, the court may, in its discretion, increase the amount of the award to an amount equal to not more than 3 times the amount available under subparagraph (B) of this paragraph."

Right to Refuse Services
While we wish we could assist all online businesses, we simply cannot. We reserve the discretion to decide to refrain from working with anyone for any reason including, but not limited to, our belief that a business or website contains inappropriate material.

Information We Collect

Required Information

Client and Membership Accounts
To become a client or to open a membership account, you must provide your name, address, phone number, and e-mail address. In order to make payments (such as to pay your fees), you must provide credit card account information, which will only be used on the PayPal or AuthorizeNet secured websites.   We may also ask you to choose one or two security questions (such as your city of birth, your favorite color or your pet's name).  These security questions allow us to issue you a new password if you forget or lose your password, to protect you against credit card fraud and to contact you if either of us have a question concerning your account.

Online Purchases
When you make a purchase using the shopping cart system on our website, we ask you to provide information specific to each order you make.  This information includes your name, address, phone number, email address, shipping and billing address, credit card account information, credit card expiration date and credit card verification number (located on the back of your credit card).  We retain this information for each of your purchases made on our website, however this information is safe and secure as long as the URL contains https and/or the lock icon appears at the bottom of your browser.  We also collect the Internet address (IP address) of the computer or device you use to make the purchase on our website in order to help detect possible instances of unauthorized transactions.

In order to protect us and our customer from potential fraud related issues, we verify your information with third parties.  Typically, this verification is limited to matching your address (both billing and shipping addresses) with the address on your credit card statement.  The billing address you provide to us is compared through your credit card company, to ensure that you are who you say you are at the time you are making a purchase on our website.

If we can not verify the information you provide (for example, your billing address does not match the address used by your bank or credit card company), we may need additional information to help verify your information.

Web Site Traffic Information
Because of the way that World Wide Web communication standards work, when you arrive at or leave the our Web site, we automatically receive the Web address of the site that you came from or are going to. We also collect information on which pages of our Web site you visit while you are visiting our site, the type of browser you use and the times you access our Web site. We use this information only to try to understand how to service the needs of our visitors better so we can improve your visit experience as well as understand the behavior trends of our visitors.  We do not ever track the sites you visit outside of our website, whether those visits occurred before or after your visit to our website. 

Our Use of "Cookies"
"Cookies" are small files of data that reside on your computer and allow us to recognize you as a member if you return to the www.capturehits.com client ONLY portion of the site using the same computer and browser. We send a "session cookie" to your computer if and when you log in to your account by entering your username and password. These cookies allow us to recognize you if you visit multiple pages in our site during the same session, so that you don't need to re-enter your password multiple times. Once you log out or close your browser, these session cookies expire and no longer have any effect.

Customer Service Correspondence

From time to time, we offer optional questionnaires and surveys to our users for such purposes as collecting demographic information or assessing users' interests and needs. The use of the information collected will be explained in detail in the survey itself. If we collect personally identifiable information from our users in these questionnaires and surveys, the users will be given notice of how the information will be used prior to their participation in the survey or questionnaire. These programs are ALWAYS optional and are not a requirement to maintain membership or to purchase our products and services, except if they are advised by our staff to better assess how we may help an individual client.

Our Use and Disclosure of Information

Internal Uses
We collect, store and process your personal information on servers located in the United States. We use the information we collect about you in order 1) to provide our services and process your transactions, 2) to provide customer service, 3) to determine your eligibility to receive offers for special features or products, and 4) to improve our products and services. Additionally, if you go into a negative balance and owe us money, we may share information with processing companies including collection agencies.

We disclose information that we in good faith believe is appropriate to cooperate in investigations of fraud or other illegal activity, or to conduct investigations of violations of our User Agreement. For example, this means that if we conduct a fraud investigation and conclude that one side has engaged in deceptive practices, we can give that person or entity's contact information (but not bank account or credit card information) to victims who request it.
  3. We disclose information in response to a subpoena, warrant, court order, levy, attachment, order of a court-appointed receiver or other comparable legal process, including subpoenas from private parties in a civil action.
  4. We disclose information to your agent or legal representative (such as the holder of a power of attorney that you grant, or a guardian appointed for you).
  5. We share aggregated statistical data with our business partners or for public relations. For example, we may disclose that a specific percentage of our users live in Florida. However, this aggregated information is not tied to personally identifiable information.
  6. As with any other business, it is possible that in the future we could merge with or be acquired by another company. If such an acquisition occurs, the successor company would have access to the information maintained by us, including customer account information, but would continue to be bound by this Privacy Policy unless and until it is amended.
  7. We share your information with our parent, subsidiaries, affiliates and joint ventures to help coordinate the services we provide to you, enforce our terms and conditions, and promote trust and safety.

Our Contacts with Our Subscribers, Members and Customers

In all cases, you must provide users with the opportunity to remove themselves from your database and review any information you have collected about them. In addition, under no circumstances, except as defined in this section, can you disclose personally identifiable information about another user to any third party without our consent and the consent of such other user after adequate disclosure. Note that law enforcement personnel and other rights holders are given different rights with respect to information they access.

Anti-Spam Policy
We do not tolerate spam!  As responsible eMarketers, we value our leads, customers, partners, employees and company associates and don't share your information with others, except as is necessary to service you.
We define spam as unsolicited commercial email which is basically, an email message that you send to someone when they did not ask to receive it.  There are many kinds of spamming.  For example, posting irrelevant messages on bulletin boards, chat rooms, blogs, etc. is just as spam as the email message arriving without the receiver's request for that information. 
We have a zero tolerance towards spam.  If you spam our site or try to resell our products/services/using spam tactics, you will be forever banned from our website.  We may also consider fining you, reporting you to law enforcement or reporting you as a spammer.  Take this policy seriously!  We simply will not tolerate spam from any member of our community.

We are committed to handling your customer information with high standards of information security. Your credit card and bank account information are stored only in encrypted form on computers that are not connected to the Internet. We restrict access to your personally identifiable information to employees who need to know that information in order to provide products or services to you. Accessing and Changing Your Information
You can review the personal information you provided us and make any desired changes to such information, or to the settings for your account. If you close your account, we will mark your account in our database as "Closed," but will keep your account information in our database. This is necessary in order to deter fraud, by ensuring that persons who try to commit fraud will not be able to avoid detection simply by closing their account and opening a new account. However, if you close your account, your personally identifiable information will not be used by us for any further purposes, nor sold or shared with third parties, except as necessary to prevent fraud and assist law enforcement, or as required by law.
